These Terms of Use ("Terms") govern your access to and use of this website (the "Site"), operated by Bruja Neo LLC, doing business as Nexvanta Security ("Nexvanta," "we," "us" or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Scope

These Terms apply only to the Site. Our professional services (managed security, SOC, technology solutions, GRC, audits, penetration testing and others) are governed by the separate written agreement, statement of work or proposal signed with each client, which controls over these Terms in case of conflict.

3. Acceptable use

You agree to use the Site only for lawful purposes. You must not:

  • access or attempt to access any system, account or data without authorization, including in violation of the Computer Fraud and Abuse Act (18 U.S.C. § 1030) or similar state laws;
  • run vulnerability scans, penetration tests, load tests or denial-of-service attacks against the Site or our infrastructure without our prior written permission, except as allowed in section 4;
  • upload or transmit malware or any code designed to harm, disrupt or gain unauthorized access to systems;
  • scrape, copy or harvest content or data from the Site by automated means;
  • use the contact form to send spam, unlawful material or content unrelated to its purpose;
  • impersonate any person or misrepresent your affiliation with any person or entity.

4. Responsible disclosure

If you find a security vulnerability in the Site or in Nexvanta's systems, please report it to soc@nexvantasecurity.com. Test only as much as needed to demonstrate the issue, do not access, modify or keep data that is not yours, do not degrade our services, and give us a reasonable time to fix the issue before disclosing it. If you follow these guidelines in good faith, we will not pursue legal action against you for your research. See also our RFC 2350 document.

5. Information on the Site

The content of the Site is provided for general information only. It is not professional, legal or security advice for your specific situation, and it is not an offer to provide services. Service descriptions, frameworks and technologies mentioned may change without notice.

6. Intellectual property

The Site and its content, including text, graphics, logos, the Nexvanta name and marks, software and design, are owned by or licensed to Nexvanta and are protected by United States and international copyright, trademark and other intellectual property laws. We grant you a limited, non-exclusive, revocable license to view the Site for your personal or internal business use. You may not reproduce, distribute, modify or create derivative works from any content without our prior written consent.

Third-party trademarks and product names mentioned on the Site belong to their respective owners and are used for identification only; their mention does not imply endorsement.

If you believe content on the Site infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to hello@nexvantasecurity.com, including the information required by that law.

7. Third-party links

The Site may link to third-party websites. We do not control and are not responsible for their content, policies or practices.

8. Disclaimer of warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Nexvanta and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising out of or related to your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Nexvanta from any claims, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

11. Governing law and venue

These Terms are governed by the laws of the State of New Mexico and applicable federal law of the United States, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of those courts.

12. Changes and termination

We may update these Terms at any time by posting a new version on this page; the date at the top shows when they were last updated. Your continued use of the Site after changes are posted means you accept them. We may suspend or restrict access to the Site for anyone who violates these Terms.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver. These Terms are the entire agreement between you and Nexvanta regarding the Site.
